I would like to know how to distribute wealth of inheritance between my family according to the Shariah. Firstly the wealth of a deceased father, between wife, 3 daughters and 1 son. Value equal to 30000. Secondly, wealth of a deceased mother, between 3 daughters and 1 son. Value equal to 90000. Both these question relate to the same matter.

If he has left no children, and the parents are the (only) heirs, the mother has a third share (Father and other heirs will have two third) ; if the deceased left brothers (or sisters), the mother has a sixth share (rest is for the children). The distribution in all cases is after the payment of legacies and debts.

Shorter Answer: It is permissible for a man to divide his wealth among his heirs during his lifetime when he is in good health, so long as he treats all his children fairly, both male and female. However, such a division is not considered inheritance according to the shari’ah ; rather, it is considered a gift ( Hibah ) provided that all the conditions of the validity of a gift set by the shari’ah are met.

The DP (of the deceased) will demand a copy of death certificate duly notarised and the succession certificate (which you got from the court) which is also duly notarized by notary people who are advocates who authenticate the certificates with their seal) or an order of the court. A copy of probate or letter of administration is also required.

The father has a right to will upto a maximum of 1/3 rd of his wealth to be given to anyone of his choice (except his legal heirs) after his death, if he wishes to make a will. After completion of payment of debts and will of the deceased, the balance wealth will be distributed exactly as per the laws of Islam to his legal heirs.
